Introduction:

Jotender ltd. agrees to your using our web site. Please read it, as you are deemed to accept Jotender ltd.’s Terms of Use each time you use the web site.

Purpose of use:

Use of this site is strictly for lawful purposes when seeking to recruit staff, or when seeking employment. Under no circumstances should you seek to undermine the security of the site or any information submitted to or available through it, for example, by seeking to access, amend, or delete any information to which you do not have authorized access, or by seeking to overload the system or using any technology or device to seek to damage the site by causing it to crash or delay.

Information submitted by you:

You are responsible for any information you submit to the site. In particular, that it is true and accurate and up to date and not misleading or likely to mislead, and that it is not discriminatory, obscene, offensive, defamatory, or otherwise illegal, unlawful, or in breach of any criminal or civil law, including the intellectual property rights of others, and not only within this jurisdiction but in any foreign jurisdiction.
You are responsible for ensuring that all information you provide is free of viruses or other engines which may damage or interfere with the site's system or data prior to your submitting it to the site.
We reserve the right at our discretion to remove any information supplied by you from the site without reason or notice.

Use of information:

We will use information supplied by you including any personal data, to assist in achieving the objectives for which that information has been given, as well as using it generally in aggregate for the purpose of and assimilating knowledge (see our Terms of business for Jotender ltd.:


Introduction:

It is to be read in conjunction with the other terms and conditions appearing on the site including Jotender ltd.'s Privacy Statement and Terms of use. By your use of the site, you are agreeing to all these terms.

Alternatives for Advertising:

As an advertising client there are three ways in which you can retain the services of jotender.com to help your business. You may advertise through a General Listing, Showcase, Premium Showcase, and for employers, Top Job listing facilities, or a combination of them.
Our Terms of Business with you are subject to these terms as well as the Privacy Statement and Terms of Use but you are deemed to agree all our terms at the point where we place material provided by you (an advertisement) on our web site, but not before. The Privacy Statement and Terms of Use are binding on you if you use the site, but they are part of our Terms of Business in any event.
We have the right to refuse to accept your advertisement or additions or amendments to it though we will normally only do so if the proposed advertisement is offensive (including infringing any advertising codes of practice or standards), infringes any criminal or civil law, or is inappropriate for a web site concerning sports recruitment. For a full description of the advertising options, please go to 'Your Dashboard' from the toolbar after logon.

Fees:

For details of fees please contact a member of the sales team on telephone number 0208 251 8116 or email admin@jotender.com. The fees assume that you will be providing the information direct onto the web site subject to it being accepted by Jotender ltd. We also operate a management service, so that if you require assistance with the formulating and/or placing of an advertisement, we will be happy to accommodate you, though a management administration fee will be charged in addition to the fees ordinarily charged for the service, to be agreed on an individual basis at the time.

Payment:

You may make payment in any of the following ways:
By Paypal or on-line transaction through our secure credit line facility. See our Policy Statement and the booking/registration page for more details.
Alternatively you can apply to Jotender ltd. for a credit account. All invoices are payable on receipt as per Client signed confirmation form(s). Late payment will entitle us to suspend provision of Services. Interest will be payable on late payments at the rate of 3% above Barclays Bank plc's base rate from time to time. Where a monthly installment plan is arranged, any default on this arrangement will result in full payment becoming due with immediate effect.

Termination:

a. The Recruiter may terminate the provision of Services in writing to us:
i. To expire at the end of the Fixed Term.
ii. In the event that we are in material breach of these terms and conditions and have not remedied such breach within ten days of notice specifying the breach and requiring that it be remedied, or:
iii. We become insolvent, cease to trade or go into liquidation
iv. Termination by the Customer before the end of the Fixed Term may, at our discretion, result in loss of discounts agreed for the entire Fixed Term.
Refunds cannot be provided if the Candidate is not of the desired age, sex, race, or nationality, as these criteria contradict our equal opportunities policy, and common decency.

Advertisement:

For the purposes of these terms an 'advertisement' includes the making of any subsequent amendments or additions.
Fees shown are for the advertisement for one job. For multiple applications please contact the sales team to discuss discounts.

Information:

The information we post on your behalf on our web site is your responsibility. We will use our best endeavours to accurately set out the information you give us but we do not accept liability for any immaterial errors. Our liability in respect of material errors, ie, those which render the advertisement valueless, are limited to a refund of the fees paid in respect of that placement.

Information continued:

Advertisers are solely responsible for the taking up of any references and satisfying yourselves with any responses you receive, including confirming any professional or academic qualifications, arranging medical examinations, and obtaining work permits. Jotender ltd. has no responsibility for the selection of one or other job seeker from those who apply through your advertisement.
We do not warrant the information you may receive from a job seeker or advertiser.
You are solely responsible for dealing with the administration of any candidates' responses to your advertisement and after employment with all administration of the candidates' remuneration and benefits.
Any information you receive will be kept confidential by you for the purposes of an application only and not under any circumstances, (without the job seeker's own consent) divulged to any third party for any purpose whatsoever.
By making the facility of this site available Jotender ltd. does not guarantee any particular level of response or performance by those job seekers who respond to an advertisement.
You will ensure and hold Jotender ltd. harmless in respect of any miss-use by you of the site, and any infringement of criminal or civil law, but in any event you will not, and not attempt to, place any information on the site (either directly or indirectly) which contravenes any such law.
Jotender ltd. is not liable to you for any loss liability damage costs claims or expenses suffered or incurred by you arising from or in connection with the use of our site or recruitment of any job seeker using Jotender ltd.'s facilities, however they may arise. Nothing in these terms will construe Jotender ltd. as agent or principal for an advertiser or a job seeker, or Jotender ltd. as an employer of a job seeker. These terms shall be governed by the laws of England and Wales and you agree to submit to the jurisdiction of the English Courts in the event of any dispute. Jotender ltd. contracts only and exclusively on these terms, and upon no other terms on which you might prefer to rely. You are deemed to have accepted these terms when you place an advertisement with us and we place it on our site. These terms may not be varied unless expressly agreed in writing by a director of Jotender ltd.

9 Third party rights:

Except for our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

10 Governing law:

The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.

12 Entire agreement:

These terms and conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the services to you by us and except where you are dealing as a consumer:
12.1 Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorized representation about the nature or quality of any services offered for sale by us; and,
12.2 Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.
